{"id":999,"date":"2007-03-22T18:11:00","date_gmt":"2007-03-22T18:11:00","guid":{"rendered":"https:\/\/mhgoldberg.com\/blog\/?p=999"},"modified":"2007-03-22T18:11:00","modified_gmt":"2007-03-22T18:11:00","slug":"fcc-launches-net-neutrality-inquiry","status":"publish","type":"post","link":"https:\/\/mhgoldberg.com\/blog\/?p=999","title":{"rendered":"FCC launches net neutrality inquiry"},"content":{"rendered":"<div style=\"text-align: justify;\"><a href=\"http:\/\/www.mhgoldberg.com\/blog\"><img decoding=\"async\" style=\"margin: 0px 10px 0px 0px; float: left; cursor: pointer;\" alt=\"FCC\" src=\"http:\/\/www.fcc.gov\/images\/fcclogowords.gif\" border=\"0\" \/><\/a>The FCC has launched an <a href=\"http:\/\/hraunfoss.fcc.gov\/edocs_public\/attachmatch\/DOC-271687A1.pdf\">inquiry<\/a> into net neutrality, although the language they used was an inquiry &#8220;into broadband market practices.&#8221;<\/p>\n<p>The FCC&#8217;s press release invites comments on:<\/p>\n<blockquote style=\"color: rgb(102, 102, 102); text-align: justify;\"><p><span style=\"font-size:85%;\"><\/p>\n<ul>\n<li>How broadband providers are managing Internet traffic on their networks today<\/li>\n<li>Whether providers charge different prices for different speeds or capacities of<br \/>service<\/li>\n<li>Whether our policies should distinguish between content providers that charge<br \/>end users for access to content and those that do not<\/li>\n<li>How consumers are affected by these practices<\/li>\n<\/ul>\n<p>The Notice of Inquiry further seeks comment on whether the Policy Statement should incorporate a new principle of nondiscrimination and, if so, how would \u201cnondiscrimination\u201d be defined, and how would such a principle read.<\/span><\/p><\/blockquote>\n<p>The Chair, Kevin Martin <a href=\"http:\/\/hraunfoss.fcc.gov\/edocs_public\/attachmatch\/DOC-271687A2.pdf\">added<\/a>:<\/p>\n<blockquote style=\"color: rgb(102, 102, 102); text-align: justify;\"><p><span style=\"font-size:85%;\">We have the dual responsibilities of creating an environment that promotes infrastructure investment and broadband deployment and to ensure that consumers&#8217; access to content on the Internet is protected. We can best fulfill these responsibilities by being fully informed.<\/span><\/p><\/blockquote>\n<p>The Notice of Inquiry process is being criticized by two of the Commissioners (<a href=\"http:\/\/hraunfoss.fcc.gov\/edocs_public\/attachmatch\/DOC-271687A4.pdf\">Adelstein<\/a> and  <a href=\"http:\/\/hraunfoss.fcc.gov\/edocs_public\/attachmatch\/DOC-271687A3.pdf\">Copps<\/a>) as being too lengthy. They would have preferred a procedure such as NPRM, that sets out a proposed rule making for comment by all parties. The majority echo the sentiments of the Chair.<\/p>\n<p>As such, it appears to me that this process is to assert FCC control of the debate. Some advocates of net neutrality have begun to cast the issue in terms of &#8216;truth in advertising&#8217; &#8211; perhaps to move the debate under the Federal Trade Commission. Their position is that non-neutral networks may be permitted, but cannot be sold as &#8216;the internet.&#8217;<\/p>\n<p>Earlier this week, the UK regulator, <a href=\"http:\/\/news.zdnet.co.uk\/communications\/0,1000000085,39286400,00.htm\">Ofcom indicated<\/a> that it believes that there are sufficient anti-discrimination provisions to deal with net neutrality concerns already existing within the EU regulatory framework.<\/p>\n<p>We&#8217;ll keep on eye on this file.<\/p>\n<p><span style=\"color: rgb(51, 204, 0);font-size:78%;\">Technorati Tags:<br \/><a href=\"http:\/\/technorati.com\/tag\/FCC\" rel=\"tag\">FCC<\/a>, <a href=\"http:\/\/technorati.com\/tag\/Ofcom\" rel=\"tag\">Ofcom<\/a>, <a href=\"http:\/\/technorati.com\/tag\/net+neutrality\" rel=\"tag\">net neutrality<\/a><\/span><\/div>\n","protected":false},"excerpt":{"rendered":"<p>The FCC has launched an inquiry into net neutrality, although the language they used was an inquiry &#8220;into broadband market practices.&#8221;
