{"id":794,"date":"2007-09-18T07:26:00","date_gmt":"2007-09-18T07:26:00","guid":{"rendered":"https:\/\/mhgoldberg.com\/blog\/?p=794"},"modified":"2007-09-18T07:26:00","modified_gmt":"2007-09-18T07:26:00","slug":"revisiting-the-dncl-exemptions","status":"publish","type":"post","link":"https:\/\/mhgoldberg.com\/blog\/?p=794","title":{"rendered":"Revisiting the DNCL exemptions"},"content":{"rendered":"<p><a href=\"http:\/\/www.crtc.gc.ca\/archive\/ENG\/Notices\/2007\/pt2007-15.htm\"><img decoding=\"async\" style=\"margin: 0pt 10px 10px 0pt; float: left; cursor: pointer;\" alt=\"CRTC\" src=\"http:\/\/www.crtc.gc.ca\/images\/welcome.jpg\" border=\"0\" width=\"218\" \/><\/a>The CRTC has a <a href=\"http:\/\/www.crtc.gc.ca\/archive\/ENG\/Notices\/2007\/pt2007-15.htm\">consultation<\/a> underway to consider the delegation of the Commission&#8217;s investigative powers with regard to Unsolicited Telecommunications Rules complaints.<\/p>\n<p>The consultation is a perfectly understandable process to make use of new bodies that can likely be better resourced to focus on such specific consumer complaints.<\/p>\n<p>However, the CRTC has added a little twist that seems to be an attempt to revisit the exemptions to the Do Not Call List rules that Parliament created in its amendments to the Telecom Act. It has asked for comment on:<\/p>\n<blockquote style=\"text-align: justify; color: rgb(102, 102, 102);\"><p><span style=\"font-size:85%;\">the Commission&#8217;s intent to establish a rule to require all telemarketers and clients of telemarketers, <span style=\"font-weight: bold;\">including those exclusively making telecommunications that are exempt from the National DNCL Rules<\/span>, to register with, and provide information to, the National DNCL operator and to pay fees that may be charged by the third party who will be responsible for the investigation of Unsolicited Telecommunications Rules complaints. [emphasis added]<\/span> <\/p><\/blockquote>\n<p>The Act seems pretty clear that exempt groups are exempt from this kind of registration:<\/p>\n<blockquote style=\"text-align: justify; color: rgb(102, 102, 102);font-size:85%;\"><p><span style=\"font-size:85%;\">[<\/span><span style=\"font-style: italic;font-size:85%;\">Section 41.7(1)<\/span><span style=\"font-size:85%;\">] An order made by the Commission that imposes a prohibition or requirement under section 41 that relates to information contained in any database or any information, administrative or operational system administered under section 41.2 for the purpose of a National DNCL <\/span><span style=\"font-weight: bold;font-size:85%;\">does not apply<\/span><span style=\"font-size:85%;\"> in respect of a telecommunication&#8230;<\/span> <\/p><\/blockquote>\n<p>and then continues to enumerate the exempt types of communications.<\/p>\n<p>How does the CRTC reconcile an intent to have exempted groups &#8220;register with, and provide information to, the National DNCL operator&#8221;, when the Act specifically exempts precisely the requirements for such information?<\/p>\n<p>As much as people may not like the exempted types of telemarketing calls, these were established by parliament.
