{"id":67,"date":"2009-11-05T06:25:00","date_gmt":"2009-11-05T06:25:00","guid":{"rendered":"https:\/\/mhgoldberg.com\/blog\/?p=67"},"modified":"2014-07-11T09:33:47","modified_gmt":"2014-07-11T13:33:47","slug":"northern-lessons-for-fcc","status":"publish","type":"post","link":"https:\/\/mhgoldberg.com\/blog\/?p=67","title":{"rendered":"Northern lessons for FCC"},"content":{"rendered":"<p><a href=\"http:\/\/gigaom.files.wordpress.com\/2009\/11\/netn-nprm-fcc-professor-letter.pdf\"><img decoding=\"async\" style=\"margin: 0pt 10px 10px 0pt; float: left; cursor: pointer;\" src=\"http:\/\/openinternet.gov\/images\/header_fcc.png\" alt=\"FCC\" border=\"0\" \/><\/a>On Monday, a remarkable letter [<img decoding=\"async\" src=\"http:\/\/www.gstconferences.com\/pdf.gif\" alt=\"\" \/> <a href=\"http:\/\/gigaom.files.wordpress.com\/2009\/11\/netn-nprm-fcc-professor-letter.pdf\">pdf<\/a>, 71KB] was filed with the FCC.<\/p>\n<p>Of particular note was the signature line &#8211; 6 leading academics who describe themselves as &#8220;professors of law who have spent many years devoted to research on the architecture of the Internet and its related policies.&#8221;<\/p>\n<ul>\n<li>Jack Balkin, Yale<\/li>\n<li>John Blevins, South Texas College of Law<\/li>\n<li>Jim Chen, University of Louisville<\/li>\n<li>Larry Lessig, Harvard<\/li>\n<li>Barbara van Schewick, Stanford<\/li>\n<li>Tim Wu, Columbia<\/li>\n<\/ul>\n<p>In their letter, the authors note that several have testified or filed comments with the FCC, and they have published widely on the topic of Network Neutrality and related internet issues. Why did they collaborate on this special letter?<\/p>\n<blockquote style=\"font-size: 85%; color: #666666; text-align: justify;\"><p>We submit this extraordinary early letter only to flag what we believe are two ambiguities in the Notice that we hope can be addressed early to provide a clearer foundation for comments.<\/p><\/blockquote>\n<p>The ambiguities are &#8220;<i>Defining Non-Discrimination<\/i>&#8221; and &#8220;<i>Reasonable Network Management<\/i>.&#8221;<\/p>\n<p>Regarding the second point, these distinguished professors of law ask if the FCC is asking for comment on what the standard should be, or proposing no clear standard at all? The letter suggests that the FCC should consider the distinction used by the CRTC in defining certain tests for an acceptable internet traffic management practice.<\/p>\n<p>These US law professors seem to be squarely at odds with the <a href=\"http:\/\/www.charlieangus.net\/newsitem.php?id=509&amp;PHPSESSID=6ed03257a1dda056ec66e76d40ef64d2\">statement<\/a> by the NDP&#8217;s critic, Charlie Angus:<\/p>\n<blockquote style=\"font-size: 85%; color: #666666; text-align: justify;\"><p>South of the border, the FCC has taken clear steps toward the establishment of internet neutrality on U.S. networks.<\/p><\/blockquote>\n<p>The professors say that the FCC&#8217;s statement is ambiguous and they point north of the border for clarity. Who should we believe?<\/p>\n<div>A CAIP <a href=\"http:\/\/cata.ca\/Media_and_Events\/Press_Releases\/cata_pr10300902.html\">press release<\/a> issued last Friday tries to compare the CRTC&#8217;s ITMP decision with the FCC&#8217;s initial Notice of Proposed Rulemaking:<\/p>\n<blockquote style=\"font-size: 85%; color: #666666; text-align: justify;\"><p>Nowhere in the FCC draft principles will one find the suggestion that higher prices for Internet access is an acceptable method of network management. By contrast, Canada\u2019s regulator, through its policy statement, has further eroded Canada\u2019s standing in international Internet metrics.<\/p><\/blockquote>\n<\/div>\n<p>On Monday, the same day that the academics cited the CRTC&#8217;s approach, CAIP issued another <a href=\"http:\/\/cata.ca\/Media_and_Events\/Press_Releases\/cata_pr11020902.html\">press release<\/a> that said:<\/p>\n<blockquote style=\"font-size: 85%; color: #666666; text-align: justify;\"><p>Despite putting in place proceedings that appear like they are progressive thinkers, the Commission has been issuing regressive decisions related to competitive issues.<\/p><\/blockquote>\n<p>Both press releases from CAIP play loosely with language, saying that the CRTC&#8217;s approach was calling for &#8220;higher prices for Internet services&#8221; to deal with growing demand.<\/p>\n<p>The letter to the FCC from the US internet law professors seems to contradict CAIP&#8217;s assertions that the CRTC&#8217;s decisions are regressive.<\/p>\n<p>We stand by <a href=\"http:\/\/j.mp\/9FUQHw\">our observation<\/a> that Canada is a leader in setting out the world&#8217;s first clearly defined framework for managing internet traffic.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>On Monday, a remarkable letter [ pdf, 71KB] was filed with the FCC.
