{"id":6494,"date":"2013-07-03T00:56:23","date_gmt":"2013-07-03T04:56:23","guid":{"rendered":"http:\/\/mhgoldberg.com\/blog\/?p=6494"},"modified":"2019-01-23T12:52:16","modified_gmt":"2019-01-23T17:52:16","slug":"appealing-code","status":"publish","type":"post","link":"https:\/\/mhgoldberg.com\/blog\/?p=6494","title":{"rendered":"Appealing code"},"content":{"rendered":"<p>As <a href=\"http:\/\/j.mp\/13WInCO\" target=\"_blank\" rel=\"noopener\">I suggested two weeks ago<\/a>, the major wireless carriers have filed an application [2 MB, <a href=\"http:\/\/j.mp\/16N8jkK\" target=\"_blank\" rel=\"noopener\">pdf<\/a>] seeking leave to appeal certain aspects of the CRTC&#8217;s <a href=\"http:\/\/j.mp\/148zZyD\" target=\"_blank\" rel=\"noopener\">Wireless Code<\/a>.<\/p>\n<p>The appeal deals with the timing of the Code coming into effect. There are contradictory messages in the <a href=\"http:\/\/j.mp\/148zZyD\" target=\"_blank\" rel=\"noopener\">Decision itself<\/a> (in paragraphs 368 and 369), followed by <a href=\"http:\/\/j.mp\/16Nk4rr\" target=\"_blank\" rel=\"noopener\">a tweet<\/a> from the CRTC:<\/p>\n<div align=\"center\">\n<blockquote class=\"twitter-tweet\"><p><a href=\"https:\/\/twitter.com\/search?q=%23CRTC&amp;src=hash\">#CRTC<\/a> provides clarification about wireless code: it does not apply to contracts signed before Dec. 2<\/p>\n<p>\u2014 CRTCeng (@CRTCeng) <a href=\"https:\/\/twitter.com\/CRTCeng\/statuses\/342737147587076097\">June 6, 2013<\/a><\/p><\/blockquote>\n<p><script async=\"\" src=\"\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/p>\n<\/div>\n<p>At that time, <a href=\"http:\/\/j.mp\/16N9h0A\" target=\"_blank\" rel=\"noopener\">I responded via Twitter<\/a> to ask if the CRTC planned to issue an erratum to clarify the decision.<\/p>\n<p>The CRTC tweet was followed by a <a href=\"http:\/\/j.mp\/12YqKG2\" target=\"_blank\" rel=\"noopener\">letter of clarification from CRTC staff<\/a>\u00a0(responding to <a href=\"http:\/\/j.mp\/12YxovR\" target=\"_blank\" rel=\"noopener\">a request from CWTA<\/a>) that appears to contradict the <a href=\"http:\/\/j.mp\/16Nk4rr\" target=\"_blank\" rel=\"noopener\">Twitter statement<\/a>.<\/p>\n<p>There had been <a href=\"http:\/\/j.mp\/12YyDeG\" target=\"_blank\" rel=\"noopener\">a legal opinion<\/a> filed during the proceeding that led to the Wireless Code which identified the problems with the CRTC issuing a decision that would result in retrospective application to as many as 5 million existing contracts.<\/p>\n<p>The carrier application seeks an award of legal costs if it is successful.<\/p>\n<p>Will lawyers advising the CRTC suggest settling, retracting the staff opinion, before risking a sizable bill for having ignored the evidence, (based in part on a 2009 Supreme Court decision in CRTC vs Bell)?<\/p>\n<p>The legal filing appears to demonstrate inconsistencies between the Decision, the social media feed and the staff letter.
