{"id":6026,"date":"2013-01-08T10:24:23","date_gmt":"2013-01-08T15:24:23","guid":{"rendered":"http:\/\/mhgoldberg.com\/blog\/?p=6026"},"modified":"2013-01-08T10:24:23","modified_gmt":"2013-01-08T15:24:23","slug":"anti-spam-or-anti-commerce","status":"publish","type":"post","link":"https:\/\/mhgoldberg.com\/blog\/?p=6026","title":{"rendered":"Anti-spam or anti-commerce"},"content":{"rendered":"<p>Canada&#8217;s anti-spam law (&#8220;<a href=\"http:\/\/j.mp\/TIGENI\" target=\"_blank\">CASL<\/a>&#8220;) is continuing down a painfully slow path toward implementation.<\/p>\n<p>To recap:<\/p>\n<ul>\n<li>The <a href=\"http:\/\/j.mp\/TIGhT8\" target=\"_blank\">CASL legislation<\/a>\u00a0itself was passed in 2010<\/li>\n<li>The <a href=\"http:\/\/j.mp\/TIGUfu\" target=\"_blank\">report of the anti-spam task force<\/a> was released in May 2005, having been established a year earlier.<\/li>\n<li>The CRTC and Industry Canada have held consultations on the regulations associated with the law. Industry Canada has just released <a href=\"http:\/\/j.mp\/TIHfz0\" target=\"_blank\">revised regulations<\/a> for public comment. The first of the CRTC&#8217;s <a href=\"http:\/\/j.mp\/Wc2vPv\" target=\"_blank\">Information Bulletins<\/a> were released last fall. The <a href=\"http:\/\/j.mp\/A2Ldee\" target=\"_blank\">CRTC&#8217;s regulations<\/a> were released last March.<\/li>\n<\/ul>\n<p>A number of commentaries have come out in the past week regarding the revised Industry Canada regulations. Michael Geist writes &#8220;<a href=\"http:\/\/j.mp\/UCtNPE\" target=\"_blank\">Canadian Government Unveils Big Loopholes in Anti-Spam Regulations<\/a>&#8220;. Michael Fekete of Osler writes &#8220;<a href=\"http:\/\/j.mp\/10bC6Vh\" target=\"_blank\">New Draft Regulations Soften Impact of CASL, but Concerns about Jobs and Compliance Costs Remain<\/a>&#8221; while David Elder at Stikeman&#8217;s writes &#8220;<a href=\"http:\/\/j.mp\/UBSo7n\" target=\"_blank\">Many business concerns remain following revisions to anti-spam regulations<\/a>&#8220;. I encourage you to read each of these commentaries.<\/p>\n<p>Regular readers will know that I share the concerns of the business lawyers; I believe the law will have the effect of <a href=\"http:\/\/j.mp\/RseXV4\" target=\"_blank\">damaging electronic commerce<\/a> in Canada.<\/p>\n<p>Different perspectives, based in large part on how far the legislation strayed from a focus on spam. Take a look at what the <a href=\"http:\/\/j.mp\/TIL7A3\" target=\"_blank\">anti-spam task force wrote<\/a> in 2005:<\/p>\n<blockquote><p>At the macro level,\u00a0spam is a direct threat to the viability of the Internet as an effective means of communication. Because of this, spam is also a direct threat to increasing economic prosperity, to more efficient public services and to the emergence of an e-economy that includes all Canadians.<\/p>\n<p>At the micro level, spam annoys and offends Internet users. It also provides a vehicle for activities that are clearly illegal \u2014 or should be. These include:<\/p>\n<ul>\n<li>malicious actions that cause harm to computers, networks or data, or use personal property for unauthorized purposes (e.g. viruses, worms, Trojan Horses, denial of service attacks, zombie networks);<\/li>\n<li>deceptive and fraudulent business practices, including online versions of traditional mail-based frauds (e.g. the &#8220;Nigerian bank account&#8221; or &#8220;419&#8221; scam, and &#8220;spoofed&#8221; websites masquerading as legitimate businesses);<\/li>\n<li>phishing emails designed for identity theft or to steal money; and<\/li>\n<li>invasions of privacy (e.g. email-address harvesting, spyware).<\/li>\n<\/ul>\n<\/blockquote>\n<p>That describes what most of us consider to be spam &#8211; and we would agree should be the target of legislation. But CASL reaches far beyond. If a new restaurant or dry cleaner opens up in your neighbourhood, CASL makes it illegal for them to send out a email blast to tell you about them. They can print flyers and drop unsolicited paper off at your door but don&#8217;t try saying the same thing electronically.<\/p>\n<p>In my view, we strayed too far from trying to target fraud. In doing so, Canada is going to cause harm to the adoption of digital technologies and electronic commerce.<\/p>\n<p>CASL is an example of what can go wrong when we try to operate without an overall Digital Economy Strategy.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Canada&#8217;s anti-spam law (&#8220;CASL&#8220;) is continuing down a painfully slow path toward implementation.
