Will CRTC approvals get in the way?<\/p>\n<p>Last November, the CRTC opened a <a href=\"http:\/\/www.crtc.gc.ca\/partvii\/eng\/2009\/8656\/P56_200917180.htm\" target=\"_blank\">file<\/a> to begin the examination of the ownership and control of Public Mobile.<\/p>\n<p>As we have come to know, the CRTC needs to affirm that carriers operating in Canada are in conformance with <a href=\"http:\/\/laws.justice.gc.ca\/eng\/T-3.4\/page-2.html#anchorbo-ga:l_II-gb:s_16\" target=\"_blank\">Telecom Act<\/a> requirements. Under Canada&#8217;s current regime, Industry Canada&#8217;s approvals for the purpose of awarding radio licenses is not considered to be sufficient.<\/p>\n<p>In Telecom Regulatory Policy <a href=\"http:\/\/www.crtc.gc.ca\/eng\/archive\/2009\/2009-428.htm\" target=\"_blank\">2009-428<\/a>, the Commission established a four-type review framework to apply to ownership and control reviews.<\/p>\n<p>In December, the CRTC <a href=\"http:\/\/www.crtc.gc.ca\/eng\/archive\/2009\/lt091218.htm\" target=\"_blank\">informed<\/a> Public Mobile that it had determined that its application was Type 2:<\/p>\n<blockquote><p>the ownership structure of Public Mobile is of a complex nature and could hold precedential value for the industry and the general public. The Commission does not consider, however, that the evidentiary record would be improved by third-party submissions.<\/p><\/blockquote>\n<p>In other words, the ownership approval is not an open-and-shut case, but we don&#8217;t need outside assistance on this one. The file has been quiet since then. The Commission has said that it will issue a formal decision and open its files for public examination upon conclusion of its review of Public Mobile&#8217;s ownership.<\/p>\n<p>Public Mobile has started its <a href=\"http:\/\/mobilesyrup.com\/2010\/03\/01\/public-mobile-unlimited-ads-pop-up-in-toronto-and-montreal\/\" target=\"_blank\">teaser ads<\/a> and it has been preparing some <a href=\"http:\/\/mobilesyrup.com\/2010\/02\/19\/how-do-you-like-the-look-of-public-mobile-stores\/\" target=\"_blank\">retail stores<\/a>.
