{"id":210,"date":"2009-06-10T06:52:00","date_gmt":"2009-06-10T06:52:00","guid":{"rendered":"https:\/\/mhgoldberg.com\/blog\/?p=210"},"modified":"2009-06-10T06:52:00","modified_gmt":"2009-06-10T06:52:00","slug":"undue-preferential-portals","status":"publish","type":"post","link":"https:\/\/mhgoldberg.com\/blog\/?p=210","title":{"rendered":"Undue preferential portals"},"content":{"rendered":"<p>Can a portal operator discriminate and provide a preference to display in-house content instead of material available from other suppliers?<\/p>\n<p>That seems to be a question arising from last week&#8217;s <a href=\"http:\/\/www.crtc.gc.ca\/eng\/archive\/2009\/2009-329.htm\">new media decision<\/a> by the CRTC.<\/p>\n<p>During the proceeding, a number of content providers, including Pelmorex (The Weather Channel) argued <\/p>\n<blockquote style=\"font-size: 85%; color: rgb(102, 102, 102); text-align: justify;\"><p>that despite new media\u2019s promise of open access, there are gatekeepers in the new media environment with the power to give certain content providers preferred access to their platforms and customer base. During the Proceeding, this issue was most frequently discussed with respect to wireless carriers that offer walled garden mobile entertainment packages. <\/p><\/blockquote>\n<p>So the CRTC determined that the imposition of an undue preference provision would be appropriate for mobile portals. <\/p>\n<blockquote style=\"font-size: 85%; color: rgb(102, 102, 102); text-align: justify;\"><p>Despite assurances from the wireless industry that walled gardens are being replaced with open Internet access, the Commission notes that closed services are the norm in advance of greater mainstream adoption of more sophisticated devices.
