{"id":1280,"date":"2006-09-10T09:02:00","date_gmt":"2006-09-10T09:02:00","guid":{"rendered":"https:\/\/mhgoldberg.com\/blog\/?p=1280"},"modified":"2006-09-10T09:02:00","modified_gmt":"2006-09-10T09:02:00","slug":"net-neutrality-and-broadcasting","status":"publish","type":"post","link":"https:\/\/mhgoldberg.com\/blog\/?p=1280","title":{"rendered":"Net neutrality and broadcasting"},"content":{"rendered":"<div style=\"text-align: justify;\"><a href=\"http:\/\/www.cbc.radio-canada.ca\/submissions\/crtc\/pdf\/CBC-BPN-2006-72-Section-15-Submission-%28Part-1-2%29-01sept20-6.pdf\"><img decoding=\"async\" style=\"margin: 0pt 10px 10px 0pt; float: left; cursor: pointer;\" alt=\"CBC\" src=\"http:\/\/www.cbc.radio-canada.ca\/images\/cbc_radio-canada.jpg\" border=\"0\" \/><\/a>On Thursday, <a href=\"http:\/\/www.michaelgeist.ca\/content\/view\/1415\/1\/\">Michael Geist<\/a> wrote about the <a href=\"http:\/\/www.cbc.radio-canada.ca\/submissions\/crtc\/pdf\/CBC-BPN-2006-72-Section-15-Submission-%28Part-1-2%29-01sept20-6.pdf\">CBC&#8217;s submission<\/a> to the <a href=\"http:\/\/www.crtc.gc.ca\/archive\/ENG\/Notices\/2006\/pb2006-72.htm\">CRTC proceeding<\/a> examining the future of broadcasting.<\/p>\n<p>He pointed out that CBC raises the issue of Net Neutrality:<\/p>\n<blockquote style=\"text-align: justify; color: rgb(102, 102, 102);\"><p><span style=\"font-size:85%;\"><b>The business case analysis for Internet video is complicated by the fact that suppliers of broadband connections may also have incentives to control the bandwidth available for Internet video.<\/b> Canadian cable companies engage in \u201cbandwidth shaping\u201d which allocates different levels of transmission capacity to different services according to the operational preferences of the cable company. This type of bandwidth shaping can ensure efficient use of transmission capacity. It can also ensure that Internet video by third parties does not become a threat to the business of the cable company, whether it be the delivery of traditional television programming to cable subscribers, VOD or the distribution of cable company-owned Internet video services.<\/span><\/p>\n<div style=\"text-align: right;\"><span style=\"text-align: right;font-size:85%;\">[<span style=\"font-style: italic;\">emphasis in original<\/span>]<\/span><\/div>\n<\/blockquote>\n<p>The CRTC has looked at this issue twice in relation to VoIP. In the original <a href=\"http:\/\/www.crtc.gc.ca\/archive\/ENG\/Decisions\/2005\/dt2005-28.htm\">2005 VoIP Decision<\/a> in 2005, the CRTC said<\/p>\n<blockquote style=\"text-align: justify; color: rgb(102, 102, 102);\"><p><span style=\"font-size:85%;\">The Commission considers that it can rely on subsection 27(2) of the Act, where appropriate, to prohibit a Canadian carrier from restricting its broadband customers from dealing with an alternative service provider of the customer&#8217;s choice. This issue can therefore be addressed by the Commission on a case-by-case basis, should it arise. Such competitive disputes are likely to be resolved by the Commission in a timely manner, using its expedited procedures.<\/span><\/p>\n<div style=\"text-align: right;\"><span style=\"text-align: right;font-size:85%;\">[<span style=\"font-style: italic;\">P. 475<\/span>]<\/span><\/div>\n<p><span style=\"font-size:85%;\">In light of the foregoing, the Commission concludes that it would not be appropriate to impose a general obligation on all broadband access providers to unbundle quality of service capabilities that these providers offer to their own customers at this time.<\/span><\/p>\n<div style=\"text-align: right;\"><span style=\"text-align: right;font-size:85%;\">[<span style=\"font-style: italic;\">P. 482<\/span>]<\/span><\/div>\n<\/blockquote>\n<p>In its recent <a href=\"http:\/\/www.crtc.gc.ca\/archive\/ENG\/Decisions\/2006\/dt2006-53.htm\">reconsideration<\/a> of the VoIP regulatory regime. the CRTC again declined to create specific Net Neutrality regulations, again citing S. 27(2) of the <a href=\"http:\/\/www.crtc.gc.ca\/eng\/LEGAL\/TELECOM.HTM\">Telecom Act<\/a>:<\/p>\n<blockquote style=\"text-align: justify; color: rgb(102, 102, 102);\"><p><span style=\"font-size:85%;\">In Decision 2005-28, the Commission considered that it could rely on subsection 27(2) of the Act, where appropriate, to prohibit a Canadian carrier from restricting its broadband customers from dealing with an alternative service provider of the customer&#8217;s choice. The Commission also considered that any such issues could be addressed on a case-by-case basis using expedited procedures and denied parties&#8217; requests for the imposition of an access condition.<\/span><\/p>\n<div style=\"text-align: right;\"><span style=\"text-align: right;font-size:85%;\">[<span style=\"font-style: italic;\">P. 132<\/span>]<\/span><\/div>\n<p><span style=\"font-size:85%;\"><br \/>Accordingly, the Commission denies the requests of Vonage and Cybersurf to re-examine the need for an access condition at this time.<\/span><\/p>\n<div style=\"text-align: right;\"><span style=\"text-align: right;font-size:85%;\">[<span style=\"font-style: italic;\">P. 134<\/span>]<\/span><\/div>\n<\/blockquote>\n<p>In relation to voice service, twice the CRTC looked squarely at whether specific conditions needed to be imposed on facilities-based ISPs. Both times, the CRTC determined that there is already sufficient protection contained within the current regulatory framework.<\/p>\n<p>What is Section 27(2)?
